1. Acceptance of these Terms

These Terms & Conditions (the “Terms”) form a binding agreement between you and EternalDFS (“EternalDFS,” “we,” “us,” or “our”), operated by EternalDFS LLC. They govern your access to and use of the EternalDFS website, applications, cards, contests, and related services (collectively, the “Service”).

By creating an account, purchasing a pack or card, entering any contest, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility, Age & Location

You must be at least 18 years old (or the age of legal majority in your jurisdiction, whichever is higher) to use the Service. Real-money contests are offered only where skill-based fantasy contests are permitted by law. The Service is void where prohibited.

The Service is not available in every jurisdiction. We use geolocation and identity-verification (“KYC”) tools and may restrict, suspend, or deny access based on your location or verification status. You are solely responsible for ensuring that your use of the Service is lawful where you are located.

3. Nature of the Service — Skill-Based Contests

EternalDFS is a collectible player-card game with a fantasy-sports outlet. Contests are skill-based: outcomes are determined predominantly by participants’ skill in selecting and managing lineups based on the real, publicly reported statistical performance of professional athletes.

EternalDFS is not a casino, sportsbook, lottery, or game of chance, and nothing in the Service constitutes betting or wagering on the outcome of any single game or athlete. Randomized elements (such as which cards appear in a pack) operate only within publicly disclosed odds and do not determine contest outcomes.

4. Accounts & Security

You must register for an account with accurate, current information and keep it updated. You may hold only one account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

We may refuse, suspend, or terminate accounts, and cancel or withhold entries or winnings, if we reasonably believe these Terms have been violated or that fraud, cheating, or unlawful activity has occurred.

5. Cards, Packs & Purchases

Packs contain cards drawn at the rarity odds published on the Service. Which specific cards a pack yields is randomized within those published odds. Cards are digital collectible game items for use within the Service.

Except as required by applicable law, all purchases of packs, cards, and entries are final and non-refundable. Prices, pack contents, odds, and availability may change at any time. Cards have no guaranteed monetary value.

6. No Investment; No Guaranteed Returns

Cards and packs are game items. They are not securities, commodities, investments, or financial instruments, and they are not sold as such. Purchasing packs or cards is not an investment.

We make no promise, representation, or guarantee of any profit, return, appreciation, resale value, or winnings. Any marketplace, lending, or “sponsor pool” feature is a gameplay feature offered for entertainment; your participation is voluntary and at your own risk, and you may lose the amounts you spend.

7. Contests, Scoring & Prizes

Each contest is governed by the rules posted for that contest, including entry requirements, roster and salary-cap rules, and the prize structure. Scoring is based on the real statistical performance of athletes under our published scoring rules. We may correct scoring based on official stat corrections or to fix errors.

No entry is guaranteed to win. We may, in our reasonable discretion, cancel, void, suspend, or modify any contest — including for insufficient entries, technical errors, suspected fraud or collusion, or events beyond our control — and refund eligible entry fees where appropriate. Prizes are subject to verification (including identity verification) and to applicable law.

8. Wallet, Payments, Fees, Withdrawals & Taxes

Deposits, purchases, and payouts are processed through approved third-party payment processors. Applicable fees (such as marketplace or processing fees) are disclosed within the Service.

Withdrawals are subject to identity verification (KYC), minimum thresholds, and review for fraud, anti-money-laundering, and legal compliance. You are solely responsible for any taxes arising from your use of the Service, including on any winnings. Chargebacks, payment fraud, or attempts to circumvent verification may result in suspension and forfeiture of funds to the extent permitted by law.

9. Marketplace & Sponsor Pool (Card Lending)

Card owners may list cards for sale in the marketplace or make cards available for other players to use through the sponsor pool. Where a shared card wins, winnings are divided per the split disclosed in the Service (for example, a share to the card owner, a share to the player, and a platform fee).

These are gameplay features, not financial products or profit-sharing investments, and no return is promised or guaranteed. All such activity is subject to these Terms, applicable fees, and our right to void transactions involving fraud or abuse.

10. Prohibited Conduct

You agree not to: use bots, scripts, or automation; collude, cheat, or manipulate contests or scoring; open or use multiple accounts; exploit bugs; engage in fraud, money laundering, or unlawful activity; circumvent geolocation, age, or identity checks; or infringe others’ rights. Violations may result in immediate suspension, forfeiture of entries and winnings, and referral to authorities.

11. Intellectual Property

The Service and its content — including software, text, graphics, card art, logos, and trademarks — are owned by EternalDFS or its licensors and are protected by law. We grant you a limited, personal, non-transferable, revocable license to use the Service for its intended purpose. Athlete names and statistics are used for identification only and do not imply any endorsement.

12. Third-Party Services & Data

The Service relies on third parties, including payment processors and sports-data providers. We are not responsible for the acts, omissions, availability, or content of third parties, and your use of their services may be subject to their own terms.

13. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, timely, or error-free, or that any content or scoring is accurate or complete.

14. Limitation of Liability

To the maximum extent permitted by law, EternalDFS and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from or related to your use of the Service. Our total aggregate liability for any claim will not exceed the greater of the amounts you paid to EternalDFS in the three (3) months before the claim or one hundred U.S. dollars (US$100).

15. Indemnification

You agree to indemnify and hold harmless EternalDFS and its affiliates, officers, and employees from any claims, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

16. Dispute Resolution; Arbitration; Governing Law

Please read this section carefully — it affects your legal rights. Except where prohibited by law, any dispute arising out of or relating to these Terms or the Service will be resolved by binding, individual arbitration, and you and EternalDFS waive the right to a jury trial and to participate in a class action. These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules.

17. Responsible Play

Play for entertainment and within your means; never spend more than you can afford to lose. You can request account limits or self-exclusion by contacting support@eternaldfs.com. 18. Changes; Termination; Contact

We may update these Terms from time to time; material changes will be communicated through the Service, and your continued use after changes take effect constitutes acceptance. We may suspend or terminate the Service or your account at any time as permitted by law.
